This website is operated by Companhia Brasileira de Distribuicao de Cosmeticos LTDA, Make Beauty International LLC, and MKB Portugal LDA (collectively, “Make Beauty”, “we”, “us”, “our”). Throughout the site, the terms “we”, “us” and “our” refer to Make Beauty International.

We offer this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”, “Terms of Service”), including additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and contributors of content.

Our store is hosted on Shopify Inc., which provides the e-commerce platform allowing us to sell products and services to you.

SECTION 1 — ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction, or that you are the age of majority in your jurisdiction and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any unlawful purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright, consumer, health or import/export regulations).

Any breach of these Terms may result in immediate termination of your Services.

We do not refund money for goods rejected or refused by customs in the country of destination, or for shipments affected by unpaid duties or taxes, as further detailed in our Shipping & Delivery Policy.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (excluding credit card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.

SECTION 3 — ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions.

We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Certain products, promotions, hybrid bundles, and digital+physical offers are designated as final sale, non-refundable and non-returnable, as specified in our Returns & Refund Policy, which forms part of these Terms.

SECTION 5A — HYBRID PRODUCTS (PHYSICAL + DIGITAL COMPONENTS)

Certain products offered by Make Beauty are Hybrid Products consisting of both:

  1. a physical product; and

  2. a digital component (such as online training, certificates, manuals, digital badges, or other digital content).

Hybrid Products are governed by:

  • SECTION 22 — Hybrid Product Delivery Policy, and

  • SECTION 23 — Digital Delivery Policy, which form an integral, legally binding part of these Terms.

By purchasing any Hybrid Product, you expressly acknowledge and agree that:

  • the digital component has independent economic value;

  • the digital component is delivered immediately after purchase;

  • digital content is non-refundable and irrevocable once delivered or accessed;

  • hybrid orders are considered partially fulfilled at the time of digital delivery;

  • any refund, where applicable, refers only to the physical component and is governed by our Returns & Refund Policy.

SECTION 5B — RETURNS & REFUNDS (PHYSICAL PRODUCTS, DIGITAL GOODS & FINAL SALE)

Our Returns & Refund Policy forms part of these Terms and is incorporated by reference.

In summary, and without limitation:

  • Digital goods, including but not limited to courses, certificates, manuals, digital badges, tutorials and downloadable content, are non-refundable, non-reversible and non-exchangeable once delivered or accessed.

  • Physical products are generally non-returnable and non-refundable except in specific cases such as confirmed defects, severe damage in transit, or wrong item shipped, as set out in the Returns & Refund Policy.

  • For Hybrid Products, any approved refund will, if applicable, apply only to the physical portion of the order; the digital portion remains non-refundable.

  • Sale items, promotional bundles, hybrid digital+physical offers, and free/bonus items are final sale, unless otherwise stated.

  • required documentation (photos, videos, proof of defect),

  • and the process for requesting a refund or replacement.

In the event of any inconsistency between summaries and the full policy, the full Returns & Refund Policy shall prevail.

SECTION 5C — SHIPPING TERMS, EXW INCOTERMS & CUSTOMS DUTIES

Our Shipping & Delivery Policy also forms part of these Terms and is incorporated by reference.

Without limitation:

  • Orders are generally shipped under EXW – Ex-Works international trade terms. Our responsibility ends when the goods are handed over to the carrier at the designated location.

  • Risk of loss, damage, delay, customs seizure, and all import duties, taxes, brokerage and handling fees pass to you once the carrier takes possession of the shipment.

  • We do not refund money for goods that are refused by customs, destroyed, returned due to unpaid duties or taxes, or abandoned by the recipient.

  • For certain international and high-demand orders, and for hybrid products, the total handling and shipping time may be up to 120 business days, as explained in the Shipping & Delivery Policy. By completing the purchase, you expressly agree to this extended delivery window where applicable.

In case of conflict between this summary and the full Shipping & Delivery Policy, the full policy shall prevail.

SECTION 6 — ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

SECTION 7 — OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service is inaccurate at any time without prior notice.

In addition to other prohibitions set forth in the Terms, you are prohibited from using the site or its content:

  • to solicit others to perform or participate in any unlawful acts;

You agree to indemnify, defend and hold harmless Make Beauty International and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, arising out of:

  • your breach of these Terms,

  • your violation of any law or the rights of a third party,

  • or your misuse of chargebacks contrary to our policies.

SECTION 15 — SEVERABILITY

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 — TERMINATION

These Terms are effective unless and until terminated by either you or us.

You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice.

Termination does not release you from obligations incurred prior to the termination date, including payment obligations, chargeback disputes, and compliance with the Returns & Refund Policy.

SECTION 17 — ENTIRE AGREEMENT

These Terms and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements.

SECTION 18 — GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.

SECTION 22 — HYBRID PRODUCT DELIVERY POLICY (DIGITAL + PHYSICAL)

22.1 — Nature of Hybrid Products
Hybrid Products include a physical item and a digital component.
The digital component is considered a material and independent value portion of the order.

22.2 — Immediate Digital Delivery
Upon successful payment, the digital component is delivered automatically (for example, via email, login access, or download link).
Digital content is non-refundable once accessed or delivered.
Access, download, or receipt of digital content constitutes partial contractual fulfillment of the order.

22.3 — Physical Delivery Window
Physical components may take up to 120 business days due to international logistics, customs inspections, high demand and carrier constraints.
By completing the purchase, the customer agrees to this maximum timeframe.
Delays within this window do not constitute grounds for refund, cancellation or chargeback.

22.4 — Chargeback Misuse
Disputes inconsistent with these Terms—including, but not limited to:

  • “item not received” claims before the maximum delivery window has expired;

  • disputes alleging non-delivery when digital content has already been delivered or accessed;

  • disputes arising from unpaid customs duties or refusal to accept the package—

constitute misuse of the dispute process.

Make Beauty will provide all digital delivery logs, metadata, course access records, carrier tracking, and policy acceptance proof to the payment processor in order to contest such disputes.

22.5 — Consent at Checkout
Completing the order confirms that the customer:

  • understands the hybrid nature of the product;

  • accepts immediate digital delivery;

  • agrees that digital delivery is non-refundable;

  • acknowledges the extended timeframe for physical delivery;

  • accepts EXW shipping terms and customs responsibility as described in our policies.

SECTION 23 — DIGITAL DELIVERY POLICY

The Digital Delivery Policy governs the immediate delivery of digital content included in Hybrid Products and forms a legally binding part of these Terms.

It includes, but is not limited to:

  • Immediate fulfillment of digital goods;

  • Independent economic value of digital components;

  • Irrevocability and non-refundable nature of digital content;

  • Timestamped digital delivery logs;

  • Stripe and Shopify metadata records;

  • Proof-of-delivery mechanisms;

  • Limitation of disputes relating to digital content;

  • Classification of orders as partially fulfilled upon digital delivery.
